TECHNICAL SPECIFICATION for the performance of research work on the topic: "Foreign experience in regulating the liability of legal actors in the use of the Internet" General information The research project "Foreign experience in regulating the liability of legal actors in the use of the Internet" (hereinafter, the research project) is being carried out in accordance with the list of research projects for the Office of the Government of the Russian Federation, approved by the Deputy Prime Minister of the Russian Federation – Chief of Staff of the Government of the Russian Federation on December 31, 2010 (No. 6844p–P42), by a contractor selected through a competitive process. 1.1 Ordering department: Department of Press Service and Information of the Government of the Russian Federation. 1.2 Source of funding: federal budget funds. Purpose and objectives of the research project 2.1 Purpose of the work: to conduct a scientific study and, on that basis, prepare a research report making it possible to identify the main existing approaches in the legislation of foreign countries to the legal regulation of the liability of legal actors in the use of the Internet for the content of information posted online. 2.2 To achieve this goal, the following tasks must be completed: 2.2.1 study of foreign legislation on the legal regulation of the liability of legal actors in the use of the Internet for the content of information posted online (using the examples of the United States, the United Kingdom, France, Germany, China, Canada, Kazakhstan, and Belarus); 2.2.2 analysis and identification of the specific features of legal regulation in the United States, the United Kingdom, France, Germany, China, Canada, Kazakhstan, and Belarus in the field of information security; 2.2.3 analysis of legal provisions, based on the resulting selection of laws and regulations concerning the legal regulation of the liability of legal actors in the use of the Internet for the content of information posted online, in the following areas: the categories of information for whose publication legal liability arises; which actions are treated as offenses when information is posted on the Internet; whether the right to block or suspend access to information resources has been established, who is granted that right, and under what conditions; the procedure for terminating the operation, within the national segment of the Internet, of websites containing information whose distribution is prohibited by national legislation, including in the interests of ensuring information security; the procedure for blocking access to such websites located abroad; on which participants in the legal relationship liability is imposed for the content of information posted on the Internet, and the nature of that liability. Expected results 3.1 The contractor shall present the results of the research project in the form of: 3.1.1 a research report on the topic, including a description of the legislation of the United States, the United Kingdom, France, Germany, China, Canada, Kazakhstan, and Belarus in the area of legal regulation of the liability of legal actors in the use of the Internet for the content of information posted online, analytical materials containing the relevant laws and regulations (individual provisions) of those countries, and the results of a comparative study of the identified provisions governing liability for the content of information posted on the Internet, 3.1.2 proposals for improving the legislation of the Russian Federation in the area of legal regulation of the liability of legal actors in the use of the Internet for the content of information posted online. Practical significance of the research project The research report prepared as part of this project may be used in developing measures aimed at improving Russian legislation with regard to the liability of legal actors in the use of the Internet for the content of information posted online, as well as harmonizing Russian legislation with international norms. Stages of the research project The research project is to be carried out in a single stage and includes: conducting research, preparing research and analytical reports and recommendations, and acceptance of the completed work. Time frame for the research project Start: from the date of signing the State Contract. Completion – report submission deadline: November 1, 2011. Requirements for reporting documentation The reporting documentation shall be submitted in the form of a research report. The research report must be prepared in accordance with GOST 7.32-2001 (a Russian state standard). It shall be submitted to the Customer and to the Department of Press Service and Information of the Government of the Russian Federation in printed form in one copy and in electronic form on magnetic media. The contractor shall ensure state registration of the research project in accordance with the current Regulations on the State Registration and Recording of Open Scientific Research and Experimental Design Work. Procedure for acceptance of the research project The results of the research project shall be accepted by the Customer on the basis of the Technical Specification and the opinion of the Department of Press Service and Information of the Government of the Russian Federation. Acceptance of the research project shall be formalized by a standard acceptance certificate. If the submitted research results require revision, the contractor shall be notified of this no later than November 10, 2011. In that case, the final version of the research results shall be submitted to the Department of Press Service and Information of the Government of the Russian Federation by November 25, 2011.
